When you make the purchase of any product from Immense Oak Technologies, Inc. (“IOT”), you are deemed as your accepting the warranty policy of IOT. All IOT sold products (“Products”) are covered by 90 days IOT warranty (“Warranty”) from the time you received the Products. IOT does not provide any additional warranty. IOT disclaims all warranties when Products are improperly stored or operated beyond stated conditions specified in products’ datasheets. All the unauthorized changes or modifications to Products are not covered by Warranty. In addition, IOT does not warrant our Products damaged by irresistible events or the events beyond IOT’s reasonable control, including but not limited to earthquake, fire, deluge, and other natural or man-made calamities. IOT does not warrant the performance, compatibility, mechanical fitness for any application of Products.

In case of malfunctioning or damaged Products within the 90 days from the time you received the Products, you should follow the following return merchandise authorization (“RMA”) procedures:

• Acquiring an RMA number. Please contact IOT or IOT’s sales representative for obtaining an RMA Number. All returns must be authorized by IOT. You can contact IOT by writing an email to [email protected].
• Returning the product. You must send back the malfunctioning products with the RMA number visible on the package. Without the RMA number, the package will not be accepted and will be returned to the sender.
• Repair or replace the product. Whether IOT will repair or replace the product is IOT’s sole decision. IOT will repair or replace at its early convenience within 45 days after receiving the returned Product.

You acknowledge and agree to bear all the risk when you purchase Products and use in your proprietary products. IOT or its suppliers should not be liable to you or any third party for any lost profits, lost revenue, lost data, or any direct, indirect, consequential, exemplary, incidental, special, compensatory or punitive damages arising from relating to the adoption or usage of Products.

To the maximum extent permitted under the application laws, IOT’s liability to you for any damages arising from or related to the usage or adoption of Products shall not exceed the amount you paid to IOT for such Products. The limited account will not enlarge notwithstanding more than one settled claim.

You agree the governing law of this warranty shall be the law of Taiwan. You further agree any and all dispute arising out of or in connection with this Warranty and/or your purchase of Product shall be exclusively referred to the Taiwan Taipei District Court for the first instance.
